Terms & Conditions for Survey Canon Hongkong Company Limited - Canon Hong Kong

Canon Hongkong Company Limited (“Canon”) is the organizer of this survey (the “Activity”).
The Activity will be held during the “Hong Kong Innovation Award Ceremony” at Charles K. Kao Auditorium on 28 November 2022, from 9 a.m. to 4 p.m.
Upon submitting the survey for the Activity, the participants (the “Participants”) shall be deemed to have read, understood and agreed to be bound by these terms and conditions (this “Agreement”).
A gift of one (1) Canon sticky note set (the “Gift”) shall be offered to Participants who have successfully completed the survey at the event venue. The quantity of Gifts is limited, which is offered on a first-come, first-served basis while stocks last. Each Participant is eligible to the maximum number of ONE (1) Gift only. Maximum TWO (2) Participants from each company are eligible to the Gift.
Canon reserves the sole and absolute right to disqualify or exclude any Participant from obtaining the Gift and/or demand the return of any Gift to Canon without prior notice, if the Participant: commits a breach of this Agreement;provides untrue, incomplete or inconsistent personal information;is found to be participating in the Activity and/or obtaining the Gift in any illegal or dishonest manner; oris reasonably considered by Canon to be suitable to be disqualified or excluded.

Personal Data
To participate in the Activity, Participants acknowledge and agree to the collection, use, storage, transfer and/or processing of their personal data by Canon for the sole purpose of the Activity (and/or through its service provider(s)). Any personal data involved is limited to the Participant’s company name, name, job title, contact number, business name card and email address for the sole purpose of the Activity and/or any other reasonable personal data for following up with the Participant’s requests related to the Activity.
Participants’ personal data collected in the Activity will be used by Canon (and/or through its service provider(s)) for one or more of the following purposes:
i. For confirming, notifying and following up with the Participants’ registration, dealing with the Participants’ enquiries, keeping record, confirming and/or updating the Activity’s arrangement and verifying the Participants’ identity;
ii. For creation, processing and maintenance of the Participant’s participation record for the administration and monitoring of the Activity;
iii. For statistical and analytical purposes; and
iv. Any other legitimate purposes as may be required or authorized under the applicable laws.
Participants’ participation in the Activity and his/her agreement to the collection, use, storage, transfer and/or processing of any of personal data is voluntary and independent. If Participants do not provide sufficient information, Participants may not be able to participate in the Activity. Canon will process any personal data provided by the Participants in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and with Canon’s privacy policy (https://hk.canon/en/consumer/web/privacy-policy) as may be amended from time to time. Separately and in addition, Participants may freely decide whether to agree to the use of personal data in receiving Canon’s direct marketing messages and promotional materials related to Canon’s business imaging solution & production printing products and services by checking the relevant opt-in box in the online survey form. Such opt-in decision is entirely optional and shall be separate and independent and shall not affect Participants’ eligibility to the Activity and/or the Gift in any circumstances.
Gift RedemptionArrangement
Photos of Gift are for reference only.
The Gift is on a first-come, first served basis, non-exchangeable for cash or any other products, non-refundable, non-transferrable and non-resalable.
Canon shall not bear any responsibility for replacing any damaged, lost or stolen Gift.
If due to any reason, including but not limited to there is a shortage of Gift or discontinuance or delay in the production of Gift, Canon is unable to distribute the Gift in accordance with this Agreement, Canon reserves the right to, at its sole and absolute discretion, postpone the distribution of the Gift or substitute any Gift with any other item of similar value, without any prior notice. Participants are not entitled to select the style or color of the Gift.
Miscellaneous
Canon (and/or through its service provider(s)) may take photos and/or video during the Activity for record purposes and/or promotion of Canon’s future events, products and/or services. Participants consent their images to be captured in photos and/or videos in the Activity (“Photos and Videos”). Participants hereby permit Canon and/or its affiliated companies and/or service providers to use, edit, modify, reproduce, publish and/or disseminate any such Photos and Videos by any means, in any manner and on any platform that Canon thinks fit for any purposes including for Canon’s internal records, marketing, publicity, promotional and any other purposes as Canon considers appropriate, including but not limited to Canon’s website, social media platforms (e.g. Facebook and LinkedIn) and/or other publications, whether within or outside of Hong Kong.
All time is based on the time of receipt at Canon’s server.
Canon is not responsible for and shall not be liable for any loss caused by any problems or technical malfunction of communication network or computer software or hardware, or malfunction of internet and/or internet system; or due to any mistake made or actions by the Participant during the online registration or the Activity.
Canon shall not be liable to Participants for any loss, damage, cost and expense directly or indirectly suffered by Participants (including but not limited to, loss of profit, loss of saving, loss of goodwill, loss of revenue or loss of contract incurred by Participants, whether anticipated or actual, or any special indirect or consequential damages of any nature whatsoever) or any action, claim and proceeding taken against Participants by any third party or parties in connection with, incidental to and consequential upon the performance of Canon and/or its employees and/or independent contractors and/or partners in relation to the Activity. Notwithstanding anything to the contrary, to the extent permitted by law, Canon’s total aggregate liability in contract, tort, equity or otherwise for any direct loss or damage arising out of or in connection with the Activity shall be limited to HK$100.
In case of any disputes, Canon reserves the right of final decision.
Canon shall have the sole and absolute right towards the Activity, including the right to cancel, postpone or change any details of the Activity without prior notice to any parties.
Canon reserves the right to amend, delete, supplement and interpret this Agreement from time to time.
Any failure or delay by Canon to exercise or enforce any right under this Agreement shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.
The provisions contained in each clause of this Agreement shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of this Agreement is determined to be illegal, invalid, or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement shall not be affected.
A person who is not a Participant in the Activity has no right at law to enforce any of this Agreement.
This Agreement shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). Participants hereby irrevocably submit to the exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with this Agreement.
This Agreement is prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.
