“Uplift for enjoyment - EOS R5 & EOS R6 Add-on & Trade-in Promotions” Terms and Conditions

1. Canon Hongkong Company Limited (“Canon”) is the organizer of “Uplift for enjoyment EOS R5 & EOS R6 Trade-in Promotion” (“Activity”).
2. The Activity is held for the period from 1 April 2021 to 30 June 2021 (both dates are inclusive) (“Promotion Period”).
3. Redemption Period of this Activity is from 16 April 2021 to 31 July 2021 (both dates are inclusive) (“Redemption Period”).
4. Upon choosing to participate in the Activity, you are deemed to have read, understood and agreed to be bound by the terms and conditions set out below (these “Terms and Conditions”).

Eligibility

5. To be eligible for the Activity, participants must purchase any one of the designated Canon products or product combination as specified in Clause 6 (“Canon Selected Products”) at Canon Online Store, Canon Image² or any one of the Canon’s Selected Authorized Dealers* in designated shop (collectively, referred to as “Canon Sales Location”) during the Promotion Period.

Part A: Purchase Redemption

7. Eligible participants who have purchased the Canon Selected Products at Canon Sales Location during the Promotion Period will be entitled to redeem the following items at special prices (“Type A Redemption Items”) corresponding to the Canon Selected Products purchased:

9. For each purchase of any one Canon Selected Product, you are entitled to redeem the corresponding Type A Redemption Items once only.
10. One kit set with body will be counted as one Canon Selected Product.
11. You are only entitled to redeem the corresponding Type A Redemption Items for each series of Canon Selected Products once in this Activity notwithstanding the number of purchases.

Part B: Trade-in / Recycle (select ONE only)

Trade-in Activity

12. Arrangement and Procedures for Trade-in Activity:
    (a) After purchasing Canon Selected Products, please complete the online product registration within fourteen (14) days after purchase.
    (b) Canon will notify you the trade-in method via email within fourteen (14) working days after having verified the documents and eligibility of the participants.
    (c) Please follow the instructions in the email and make appointment at reservation page to attend Canon Image² in person during the appointed session (“Appointed Timeslot”) with eligible used camera or camera with lens for trade-in, as well as the Canon Selected Product purchased and registered during the Promotion Period , original invoice issued by Canon Sales Location and purchase record card of the Canon Selected Product purchased during the Promotion Period. For eligible used camera or camera with lens details, please refer to the reservation page.
13. Mirama Camera and Hi-Fi Co. Ltd is the Trade-in service provider of the Activity (“Service Provider”) and provided Trade‐in reference price. The actual Trade-in price will be adjusted based on the condition of the camera or lens. The Trade-in price provided by the Service Provider on the Appointed Timeslot shall be final. The Service Provider shall provide Trade-in receipt after Trade-in service. The Trade-in service is subject to the terms and conditions of the relevant Service Provider.

Recycle Activity

14. Arrangement and Procedures for Recycle Activity:
    (a) After purchasing Canon Selected Products, please complete the online product registration within fourteen (14) days after purchase.
    (b) Canon will notify you the recycle method via email within fourteen (14) working days after having verified the documents and eligibility of the participants.
    (c) Please follow the instructions in the email and attend Canon Image² in person during opening hours within the Redemption Period with any Canon-brand Camera with original battery and charger which has been registered on or before 31st December 2020 under same Club Canon Account as the Canon Selected Product purchased during the Promotion Period, as well as the Canon Selected Product purchased and registered during the Promotion Period, original invoice issued by Canon Sales Location and purchase record card of the Canon Selected Product purchased during the Promotion Period.
15. The collection of the used camera will be done by Canon.
16. To agree surrendering the ownership of camera to Canon, you shall complete a “Product Receipt Form” subject to terms and conditions stated therein. For avoidance of doubt, save and except eligibility for the Type B Redemption Items below, no consideration will be given in return of such surrender.

Post-Trade in / Recycle Redemption

17. After completing the Trade-in or Recycle Activity above, you may purchase one of the Type B Redemption Items at Canon Image2 by presenting all of the below documents / items within the Redemption Period:
    (a) Original purchase record card of Canon Selected Products;
    (b) Original invoice of the Canon Selected Products issued by Canon Sales Location during the Promotion Period;
    (c) Purchased and registered Canon Selected Products during the Promotion Period; and
    (d) Original Trade-in receipt issued by the Service Provider (Applicable to the participants of Trade-in Activity only) or the completed “Product Receipt Form” in Canon’s standard format (Applicable to the participants of Recycle Activity only)

18. The original purchase record card and original invoice of the Selected Canon products will be stamped and returned to you to complete the redemption. You cannot redeem the Type B Redemption Items if you fail to present all of the abovementioned documents / items.
19. Redemption Items are not transferrable, or exchangeable for cash and/or any other goods.
20. You are only entitled to participate either Trade-in or Recycle Program and you are only entitled to participate once for each series of Canon Selected Products notwithstanding the number of purchases.
21. You are only entitled to redeem Type B Redemption Items for each series of Canon Selected Products once in this Activity notwithstanding the number of purchase or trade-in.

Disqualification

22. Canon reserves the sole and absolute right to disqualify or exclude you from the Activity and/or eligibility for redeeming the Redemption Items (see below definition) without prior notice if you:
    (i) commit a breach of these Terms and Conditions;
    (ii) provide untrue or invalid personal information;
    (iii) provide inconsistent personal information at the time of enrollment and redemption;
    (iv) are found to be participating in the Activity in any illegal or dishonest manner; or
    (v) are considered by Canon to be suitable to be disqualified or excluded under reasonable circumstances.

Personal Data

23. The personal data provided will be used by Canon for one or more of the following purposes:
    (i) For notifying you of Activity’s arrangement and verifying your identity;
    (ii) For creation, processing and maintenance of your enrollment record, the administration and monitoring of the Activity;
    (iii) For statistical and analytical purposes; and
    (iv) Any other legitimate purposes as may be required, authorized by law.
    
    The provision of personal data is voluntary. If you do not provide sufficient information, you may not be able to enroll in the Activity. Canon will treat the personal data provided by you in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and with our privacy policy (https://hk.canon/en/consumer/web/privacy-policy) amended from time to time.
24. The personal data you provided is mainly for use within Canon but the information may also be disclosed by Canon to other third parties for the purposes stated above, if required.
25. You have the right to request access to and correction of your personal data under sections 18 and 22 and principle 6, schedule 1 of the Personal Data (Privacy) Ordinance (Cap.486). Canon may impose a fee for complying with a data access request.

Miscellaneous

27. Redemption of the Redemption Items are final and Redemption Items are not transferrable or exchangeable for cash and/or any other goods. No requests for exchange for other Redemption Items will be accepted.
28. All Redemption Items are available on a first come, first served basis while stock lasts.
29. Offer in this Activity cannot be used in conjunction with any other promotional offers, discount and/or activity.
    
30. Canon will under no circumstance be liable for any loss or damage caused by any problem or technical malfunction of any communication network, online system or computer hardware or software failure; or any incorrect data input during the online registration.
    
31. All time is based on the time of receipt at the Canon server. Late registration will not be accepted.
    
32. Canon shall not be liable to you for any loss, damage, cost and expense directly or indirectly suffered by you (including but not limited to, loss of profit, loss of saving, loss of goodwill, loss of revenue or loss of contract incurred by you, whether anticipated or actual, or any special indirect or consequential damages of any nature whatsoever) or any action, claim and proceeding taken against you by any third party or parties in connection with, incidental to and consequential upon the performance of Canon or its employees or independent contractors in relation to the Activity. Notwithstanding anything to the contrary, to the extent permitted by law, Canon’s total aggregate liability in contract, tort, equity or otherwise for any direct loss or damage arising out of or in connection with the Activity shall be limited to HK$100.
33. Any failure or delay by Canon to exercise or enforce any right under these Terms and Conditions shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.
    
34. The provisions contained in each clause of these Terms and Conditions shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of these Terms and Conditions is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
    
35. Canon reserves the right to amend, delete, supplement and interpret these Terms and Conditions from time to time.
    
36. In case of any dispute, Canon reserves the right of final decision.
    
37. Canon shall have the sole and absolute right towards the Activity, including the right to cancel, postpone or change any details of the Activity without prior notice to any parties.
38. A person who is not a participant in the Activity has no right at law to enforce any of these Terms and Conditions.
39. These Terms and Conditions shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). You hereby irrevocably submit to the exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with these Terms and Conditions.
    
40. These Terms and Conditions are prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.
