Club Canon “Photo of the Month” Photography Competition Terms and Conditions
- Canon Hongkong Company Limited (“Canon”) is the organizer of Club Canon “Photo of the Month” Photography Competition (“Competition”).
- The Competition is held from 19th April 2024 - 31st May 2024 (both dates inclusive) (“Participation Period”). The date of the Competition topic announcement is subject to the decision of Canon.
- Upon participating in the Competition following the ways mentioned below, you are deemed to have read, understood and agreed to be bound by the terms and conditions set out below (these “Terms and Conditions”).
Rules and Eligibility
- Participant must be a Club Canon member.
- Participant must be the sole owner of all copyrights and any other intellectual property rights of the submitted photos.
- Submitted photos must match the topic of the Competition that month and do not contain elements of crimes, violence, obscenity, indecency, libel, defamation, privacy invasion, politics or otherwise violation or infringement of any laws and regulations.
- Canon will review the submitted photos. Any photos that do not match the topic of the Competition or contain inappropriate content will be disqualified and will not be shared and shown on the Club Canon’s website.
- Participant can choose to participate in the Competition via Club Canon’s website or via Instagram.
- Canon reserves the right to ask participant to provide original image file containing EXIF image information and complying with specific requirements for verification purpose.
Submission via Club Canon’s website
- Participant must submit , during the Participation Period, photos taken with any Canon camera and lens and in relevant photo formats:
- Recommended measurement of between 1000 px to 6000 px on the longer side and at least 768px on the shorter side.
- Photos uploaded must be saved in JPEG format with a file size of 15MB or below and are recommended to contain EXIF image information.
- Participant can upload a maximum of 50 photos each month. Any photos deleted by the end of that month will not be judged.
- By submitting the photos on Club Canon’s website, you have at the same time agreed and authorized Canon to use the photos so submitted and publish such photos in any of its publications including but not limited to the monthly e-newsletter to members and Club Canon or Canon’s official websites or social media without prior notice.
Submission via Instagram
- Participant must submit photos (regardless of whether the photos are taken using Canon camera and lens) and follow the steps below during the Participation Period:
- Step 1: Publish photos with a public account on Instagram; and
- Step 2: Tag @canonhongkong and add designated hashtags in the caption of the photos.
- Participant shall ensure the photos remain published and comply with the above requirements up to the end of 1 month after the Participation Period. Any photos that are deleted or otherwise found to be non-compliant by the end of this 1 month’s period will not be judged.
- After the Participation Period, Canon will obtain from you via Instagram inbox message your email address, which should be same as the email address registered under your Club Canon member account, for prizes (“Prizes”) redemption arrangement (if applicable).
- If your photo is selected as the winning photo, you have to follow Canon’s instructions to upload the photo on Club Canon's website within a required period. By uploading the photo on Club Canon’s website, you have at the same time agreed and authorized Canon to use the photo so submitted and publish such photo in any of its publications including but not limited to the monthly e-newsletter to members and Club Canon or Canon’s official websites or social media without prior notice.
Disqualification
- Canon reserves the sole and absolute right to disqualify or exclude you from this Competition and/or Prizes without prior notice if you:
- commit a breach of these Terms and Conditions;
- edit or cancel the photo and/or the caption on Club Canon’s website and/or Instagram (if applicable) during the Participation Period or otherwise after participating in the Competition;
- do not upload the photo to Club Canon’s website or publishing the photo on Instagram during the Participation Period;
- fail to provide the original image file of the photo or upload the photo on Club Canon’s website as per Canon’s requirements (if applicable);
- fail to use Canon camera and lens in taking the photo submitted(only applicable to submission via Club Canon's Website);
- provide incorrect or incomplete or otherwise fail to provide personal information and/or contact details as per Canon’s request;
- provide inconsistent personal information at the time of enrollment and redeeming Prize;
- are found to be participating in this Competition in any illegal or dishonest manner; or
- are considered by Canon to be suitable to be disqualified or excluded under reasonable circumstances.
Result Announcement and Prize Redemption Arrangement
- The details of the Prizes and the criteria for getting the Prizes each month will be announced by Canon separately.
- After the Participation Period, photos will be judged by professional photographer(s) and the result will be announced on Club Canon’s website within a month.
- Canon will notify the winner of details of the Prizes redemption arrangement by email or SMS, according to email address or mobile phone number registered under your Club Canon member account within 1 month after the end of the Participation Period. If, due to any reason (including but not limited to incomplete or incorrect information provided by you), Canon is unable to notify you within 1 month after the end of the Participation Period or you have not provided the required information or redeemed the Prizes within 30 days after the notification has been sent out, you shall be deemed to have waived your rights to receive the Prizes and Canon shall be entitled to exercise its sole and absolute discretion to disqualify you, and to use such Prizes for any purposes as Canon deems fit.
- The Prizes are not transferable or exchangeable for cash and/or any other goods. Canon will not accept any requests for changing the Prizes.The Prizes are not transferable or exchangeable for cash and/or any other goods. Canon will not accept any requests for changing the Prizes.
- Image of Prizes (if applicable) is for reference only.
- The use of the Prizes and related services is subject to the terms and conditions of the relevant merchant.
- Canon shall not bear any responsibility for replacing any damaged, lost, stolen or expired Prizes.
- Any Prizes and related services provided by other merchants (if applicable) shall be provided by the relevant merchants to you directly. All legal responsibilities shall be borne by the relevant merchants. Canon is not liable nor does it provide any representation or guarantee regarding the quality of any products and/or services.
- If due to any reason caused by the relevant merchants, including but not limited to the relevant merchants have a shortage of Prizes or discontinuance in the production of Prizes (if applicable), Canon is unable to distribute the Prizes in accordance with these Terms and Conditions, Canon reserves the right to, at its sole and absolute discretion, postpone the distribution of the Prizes or substitute any Prizes with any other item of similar value, without any prior notice. You are not entitled to select the style or color of the Prizes.
Personal Data
- You shall provide personal information including name and email address to Canon for the purpose of redemption of Prizes (if applicable). You acknowledge and agree that such personal data may be transferred to third party service providers for the purposes of redemption of Prizes.
- You acknowledge and agree to the collection of your personal data by Canon during the course of and for the Competition. You also agree and authorize Canon to use your personal data so collected for the purposes of the Competition, including making contact, record, publication, promotion and any other relevant purposes.
- The personal data provided by you and collected by Canon will be used by Canon for one or more of the following purposes:
- For notifying you of Competition’s arrangement and verifying your identity;
- For creation, processing and maintenance of your enrollment record for the administration and monitoring of this Competition;
- For statistical and analytical purposes; and
- Any other legitimate purposes as may be required or authorized by law.
- Your participation in the Competition and agreement to the collection, use, storage, transfer and/or processing any personal data is voluntary and independent. If you do not provide sufficient information, you may not be able to join the Competition. The personal data you provided is mainly for use within Canon but the information may also be disclosed by Canon to other third parties for the purposes stated above, if required. Canon will treat the personal data provided by you in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”) and our privacy policy (https://hk.canon/en/consumer/web/privacy-policy) amended from time to time. If you would like any further information regarding our policies and practices or like to exercise your rights under PDPO, please refer to our privacy policy.
- Any personal data provided to Canon may be processed, accessed, stored and/or transferred outside Hong Kong and/or Macau and/or to Canon’s affiliates or third party service providers including but not limited to cloud server providers situated outside Hong Kong and/or Macau. Such locations may offer a different level of protection of personal data. If Canon transfers your personal data outside Hong Kong and/or Macau, Canon will make sure to protect your personal data by applying the level of protection required under applicable data privacy laws.
Miscellaneous
- Canon shall not be liable to you for any loss, damage, cost and expense directly or indirectly suffered by you (including but not limited to, loss of profit, loss of saving, loss of goodwill, loss of revenue or loss of contract incurred by you, whether anticipated or actual, or any special indirect or consequential damages of any nature whatsoever) or any action, claim and proceeding taken against you by any third party or parties in connection with, incidental to and consequential upon the performance of Canon, its employees, independent contractors, agents, advertising agencies and/or collaborating partners in relation to this Competition. Notwithstanding anything to the contrary, to the extent permitted by law, Canon’s total aggregate liability in contract, tort, equity or otherwise for any direct loss or damage arising out of or in connection with this Competition shall be limited to HK$100.
- Canon is not responsible for and shall not be liable for any loss or damage caused by any problems, technical malfunction or security vulnerability of any communication network, computer hardware or software or internet system; or due to any mistake made or actions by you during the Competition.
- This Competition is uncorrelated with Facebook and Instagram, and is not sponsored, supported or managed by Facebook or Instagram. Facebook and Instagram shall not bear any responsibility arising from or in connection with this Competition.
- All time is based on the time of receipt at the server or record of Canon’s Instagram account. Late registration will not be entertained.
- Any failure or delay by Canon to exercise or enforce any right under these Terms and Conditions shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.
- The provisions contained in each clause of these Terms and Conditions shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of these Terms and Conditions is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
- Canon shall have the sole and absolute right towards this Competition, including the right to cancel, postpone or change any details of the Competition without prior notice to any parties.
- Canon reserves the right to amend, delete, supplement and interpret these Terms and Conditions from time to time.
- Canon reserves the right to interpret these Terms and Conditions. In case of any dispute, Canon reserves the right of final decision.
- A person who is not a participant in this Competition shall have no right at law to enforce any of these Terms and Conditions.
- These Terms and Conditions shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region (“Hong Kong”). You hereby irrevocably submit to the exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with these Terms and Conditions.
- These Terms and Conditions are prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.
