“EOS R5 | EOS R6 – CHILL Rewards Promotions” Terms and Conditions

1. Canon Hongkong Company Limited (“Canon”) is the organizer of “EOS R5 | EOS R6 – CHILL Rewards Promotions” (the “Activity”).
2. Promotion Period of the Activity is from 1 August 2022 to 30 September 2022 (both dates are inclusive) (the “Promotion Period”).
3. Redemption Period of the Activity is from 15 August 2022 to 31 October 2022 (both dates are inclusive) (the “Redemption Period”).
4. Upon choosing to participate in the Activity, the participants shall be deemed to have read, understood and agreed to be bound by these terms and conditions (these “Terms and Conditions”).

I. Eligibility

5. To be eligible for the Activity, participants must purchase the designated Canon product(s) or product combination as specified in Clause 9 (“Canon Selected Products”) at Canon Online Store, Canon Image Square or designated shop of any one of the Canon’s Selected Authorized Dealers* (collectively, referred to as “Canon Sales Location”) during the Promotion Period.
6. Participant must be holder of Hong Kong or Macau Identity Card.
7. Hong Kong Identity Card holders (“Hong Kong Residents”) who purchase Canon Selected Products at Canon Online Store, Canon Image Square or designated shop of any one of the Canon’s Selected Authorized Dealers in Hong Kong region as specified in Clause 9 (collectively, referred to as “Canon Sales Location in Hong Kong”) shall refer to “Redemption Procedure and Arrangement for Hong Kong Residents” (Section II, Part A, item (i) and Section II, Part B) for activity details; Macau Identity Card holders (“Macau Residents”) who purchase Canon Selected Products at Canon Online Store or designated shop of any one of the Canon’s Selected Authorized Dealers in Macau region as specified in Clause 9 (collectively, referred to as “Canon Sales Location in Macau”) shall refer to “Redemption Procedure and Arrangement for Macau Residents” (Section II, Part A, item (ii) and Section II, Part B) for activity details.
8. Hong Kong Residents who purchase Canon Selected Products at Canon Sales Location in Macau or Macau Residents who purchase Canon Selected Products at Canon Sales Location in Hong Kong will not be eligible for the Activity.

II. Redemption Details
Part A: Cash Coupon Redemption

(i) Redemption Procedure and Arrangement for Hong Kong Residents (Choose one Type A1 or A2 Redemption Item only)

10. Eligible participants who are Hong Kong Residents and have purchased the Canon Selected Products at Canon Sales Location in Hong Kong during the Promotion Period will be entitled to choose to redeem complimentarily one Type A1 or A2 redemption item (“Type A1-A2 Redemption Item”) corresponding to the Canon Selected Products purchased:

11. Redemption Procedure and Arrangement:
    1. Eligible participants who are Hong Kong Residents should complete the online product registration within fourteen (14) days after purchasing Canon Selected Products at Canon Sales Location in Hong Kong.
    2. After completing the product registration, Canon will issue corresponding Type A1 Redemption Item (Canon Electronic Cash Coupon) to eligible participants via email (“Redemption Item Email”) within fourteen (14) working days.
    3. Eligible participants who would like to exchange Canon Electronic Cash Coupon (Type A1 Redemption Item) for Canon Cash Coupon (Type A2 Redemption Item) should follow the instructions in the Redemption Item Email and attend Canon Image Square in person during its opening hours within fourteen (14) days after receiving the Redemption Item Email, but on or before 31 October 2022, with the following documents / items:
       1. Original invoice and original purchase record card of the Canon Selected Product purchased at Canon Sales Location in Hong Kong and duly registered during the Promotion Period; and
          
       2. The unused Canon Electronic Cash Coupon as shown in printed or electronic copy of the Redemption Item Email.
    4. Participant cannot redeem the Type A2 Redemption Item if participant fails to present all of the abovementioned documents / items.
    5. Participant cannot redeem the Type A2 Redemption Item if the Canon Electronic Cash Coupon (Type A1 Redemption Item) has been used or has expired.
    6. Upon the exchange for Canon Cash Coupon (Type A2 Redemption Item), the Canon Electronic Cash Coupon (Type A1 Redemption Item) issued in the Redemption Item Email will be voided. The original purchase record card and original invoice of the Canon Selected Products will be stamped and returned to participant to complete the exchange.
       

Redemption Restrictions for Part A, item (i)

12. As specified in Clause 9, one camera body with lens kit set will be counted as one Canon Selected Product.
13. One Canon Selected Product will only entitle a participant to redeem one corresponding Type A1 or Type A2 Redemption Item (to choose one among the two choices) for each series of Canon Selected Product and once in the Activity.
14. Each registered Club Canon Account email and mobile phone number will only entitle a participant to redeem the corresponding Type A1-A2 Redemption Item for each series of Canon Selected Products once in this Activity notwithstanding the number of purchases.
15. The offer of the Type A1-A2 Redemption Item is only available to the eligible participants and cannot be transferred to others. Canon will verify the account name and identity at time of redemption.
16. Redemption Items are not transferrable or exchangeable for cash and/or any other goods.

(ii) Redemption Procedure and Arrangement for Macau Residents

17. Eligible participants who are Macau Residents and have purchased the Canon Selected Products at Canon Sales Location in Macau during the Promotion Period will be entitled to redeem complimentarily one Type A3 redemption item (“Type A3 Redemption Item”) corresponding to the Canon Selected Products purchased:

18. Redemption Procedure and Arrangement:
    1. Eligible participants who are Macau Residents should complete the online product registration within fourteen (14) days after purchasing Canon Selected Products at Canon Sales Location in Macau.
    2. After completing the product registration, Canon will issue corresponding Type A3 Redemption Item to eligible participants via email (“Redemption Item Email”) within fourteen (14) working days.

Redemption Restrictions for Part A, item (ii)

19. As specified in Clause 9, one camera body with lens kit set will be counted as one Canon Selected Product.
20. One Canon Selected Product will only entitle a participant to redeem one corresponding Type A3 Redemption Item for each series of Canon Selected Product and once in the Activity.
21. Each registered Club Canon Account email, mobile phone number and Macau address will only entitle a participant to redeem the corresponding Type A3 Redemption Item for each series of Canon Selected Products once in this Activity notwithstanding the number of purchases.
22. The offer of the Type A3 Redemption Item is only available to the eligible participants and cannot be transferred to others. Canon will verify the account name and identity at time of redemption.
23. Redemption Items are not transferrable or exchangeable for cash and/or any other goods.

Part B: Additional Redemption Offer after Completion of Warranty Registration

24. After completing the product registration, eligible participants who purchase EOS R5 series will be entitled to the following additional offer to redeem selected item at special price (“Type B Redemption Item”):

(i) Redemption Procedure and Arrangement

25. After completion of warranty registration, eligible participants of EOS R5 series will receive eCoupon for redeeming Type B Redemption Item at the same time in Redemption Item Email . Eligible participants shall redeem the Type B Redemption Item at a specified time during the Redemption Period in accordance with the redemption details and instructions in the email.
26. To redeem the Type B Redemption Item in Canon Online Store using the eCoupon, participants must use the same Club Canon Account for purchasing and registering the Canon Selected Product during the Promotion Period.
27. Redemption Items are not transferrable or exchangeable for cash and/or any other goods.

Redemption Restrictions for Part B

28. As specified in Clause 9, one camera body with lens kit set with body will be counted as one Canon Selected Product.
29. One Canon Selected Product will only entitle a participant to redeem one piece of Type B Redemption Item for each series of Canon Selected Products and once in the Activity.
30. Each registered Club Canon Account email and phone number (and Macau address, if applicable) will only entitle a participant to redeem the corresponding Type B Redemption Item for each series of Canon Selected Products once in this Activity notwithstanding the number of purchases.
31. The offer of the Type B Redemption Item is only available to the eligible participants and cannot be transferred to others. Canon will verify the account name and identity at time of redemption.
32. Redemption Items are not transferrable or exchangeable for cash and/or any other goods.

III. Disqualification

33. Canon reserves the sole and absolute right to disqualify or exclude any participant from the Activity and/or redeeming the Type A1-A2 or Type A3 Redemption Items and/or Type B Redemption Items (“Redemption Items”) and/or demand the return of any Redemption Items to Canon without prior notice if the participant:
    i. commits a breach of these Terms and Conditions;
    ii. provides untrue or invalid personal information;
    iii. provides inconsistent personal information at the time of enrollment and redemption;
    iv. is found to be participating in the Activity and/or redeeming the Redemption Items in any illegal or dishonest manner; or
    v. is reasonably considered by Canon to be suitable to be disqualified or excluded.

IV. Personal Data

34. Participants acknowledge and agree to the collection of their personal data by Canon during the course of and for the Activity. Participants also agree and authorize Canon to use their personal data so collected for the purposes of the Activity, including making contact, record and all relevant purposes.
35. The personal data provided by participants and collected by Canon will be used by Canon for one or more of the following purposes:
    i. For notifying participants of Activity’s arrangement and verifying participants’ identity;
    ii. For creation, processing and maintenance of participants’ enrollment record for the administration and monitoring of the Activity;
    iii. For statistical and analytical purposes; and
    iv. Any other legitimate purposes as may be required, authorized by law.
    The provision of personal data is voluntary. If participants do not provide sufficient information, participants may not be able to enroll in the Activity. Canon will treat the personal data provided by participants in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and with Canon’s privacy policy (https://hk.canon/zh_HK/consumer/web/privacy-policy)amended from time to time.
36. The personal data provided by participants are mainly for use within Canon but the information may also be disclosed by Canon to other third parties for the purposes stated above, if required.
37. Participants have the right to request access to and correction of participants’ personal data under sections 18 and 22 and principle 6, schedule 1 of the Personal Data (Privacy) Ordinance (Cap.486). Canon may impose a fee for complying with a data access request.
38. Enquiries concerning the personal data provided, including the request for access and correction, should be addressed to:

V. Miscellaneous

39. Redemption of the Redemption Items is final and Redemption Items are not transferrable or exchangeable for cash and/or any other goods. No requests for exchange for other Redemption Items will be accepted.
40. All Redemption Items are available on a first come, first served basis while stock lasts.
41. Offer in this Activity cannot be used in conjunction with any other promotional offers, discount and/or activity.
42. The use of the Redemption Items and the related services are subject to the terms and conditions of the relevant merchants.
43. Redemption Items and its related products and/or services shall be provided by the relevant merchants to participants directly. All legal responsibilities shall be borne by the relevant merchants. Canon is not liable nor does it provide any representation or guarantee regarding the quality of any products and/or services.
44. If due to any reason, including but not limited to shortage of Redemption Items or discontinuance or delay in the production of Redemption Items, Canon is unable to distribute the Redemption Items in accordance with these Terms and Conditions, Canon reserves the right to, at its sole and absolute discretion, postpone the distribution of the Redemption Items or substitute any Redemption Items with any other item of similar value, without any prior notice. Participants are not entitled to select the style or color of the Redemption Items.
45. Canon is not responsible for and shall not be liable for any loss or damage caused by any problems, technical malfunction or security loophole of any communication network, computer hardware or software or internet system; or due to any mistake made or actions by the participants during the Activity.
    
46. Unless otherwise specified in these Terms and Conditions, all time is based on the time of receipt of information submitted at the Canon server. Late registration will not be accepted.
    
47. Canon shall not be liable to participants for any loss, damage, cost and expense directly or indirectly suffered by participants (including but not limited to, loss of profit, loss of saving, loss of goodwill, loss of revenue or loss of contract incurred by participants, whether anticipated or actual, or any special indirect or consequential damages of any nature whatsoever) or any action, claim and proceeding taken against participants by any third party or parties in connection with, incidental to and consequential upon the performance of Canon and/or its employees and/or its independent contractors and/or its collaborating partners in relation to the Activity. Notwithstanding anything to the contrary, to the extent permitted by law, Canon’s total aggregate liability in contract, tort, equity or otherwise for any direct loss or damage arising out of or in connection with the Activity shall be limited to HK$100.
    
48. Any failure or delay by Canon to exercise or enforce any right under these Terms and Conditions shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.
    
49. The provisions contained in each clause of these Terms and Conditions shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of these Terms and Conditions is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
    
50. Canon reserves the right to amend, delete, supplement and interpret these Terms and Conditions from time to time.
    
51. In case of any dispute, Canon reserves the right of final decision.
52. Canon shall have the sole and absolute right towards the Activity, including the right to cancel, postpone or change any details of the Activity without prior notice to any parties.
    
53. A person who is not a participant in the Activity shall have no right at law to enforce any of these Terms and Conditions.
54. These Terms and Conditions shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). Participants hereby irrevocably submit to the exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with these Terms and Conditions.
    
55. These Terms and Conditions are prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.
